1. Scope and Provider

These Terms of Service ("Terms") govern the use of the TradeMate application ("App"). The App is provided by:

("Company", "we", "us")

These Terms apply to all users of the App ("User", "you").

2. Description of Services

TradeMate is a digital application that enables users to:

• Document trading activities
• Analyze trades
• Synchronize trading-related data

The App is provided solely as a tool for documentation and analysis.

3. Apple App Store Terms

If you access the App via the Apple Inc. App Store:

• These Terms are concluded between you and the Company, not with Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support services
• Apple is a third-party beneficiary of these Terms and may enforce them

Use of the App must comply with applicable App Store terms and policies.

5. High-Risk Activity Disclaimer

Trading (including but not limited to stocks, cryptocurrencies, and derivatives) involves significant risk. You acknowledge that:

• Losses may exceed your expectations
• Past performance is not indicative of future results
• The App does not guarantee accuracy or completeness of data

The Company does not assume any responsibility for financial losses.

6. Account Registration

Access to the App requires account registration via Apple authentication. You agree to:

• Provide accurate information
• Keep your account secure
• Accept responsibility for all activity under your account

7. Subscription and Payment

• Subscription: €9.99 per month
• Payments are processed via Apple's in-app purchase system

Billing, renewals, and cancellations are handled exclusively by Apple.

8. Term and Termination

You may cancel your subscription at any time via your Apple account. We reserve the right to suspend or terminate accounts and remove content in case of violations of these Terms.

9. Acceptable Use

You agree not to:

• Use the App for illegal purposes
• Engage in spam or abusive behavior
• Attempt to reverse engineer or disrupt the App
• Exploit technical vulnerabilities or debugging systems
• Upload harmful, misleading, or unlawful content

Repeated violations may result in permanent account termination.

10. User Content

Users may upload content (e.g., charts). By uploading content, you:

• Grant the Company a non-exclusive, worldwide license to store and display such content
• Confirm that you have the necessary rights

We may remove content at our discretion.

11. Intellectual Property

All intellectual property rights in the App remain with the Company. You are granted a limited, non-exclusive, non-transferable license to use the App.

12. Availability

The App is provided on an "as is" and "as available" basis. We do not guarantee:

• Uninterrupted availability
• Error-free operation
• Data accuracy

13. Limitation of Liability

To the fullest extent permitted by law:

• The Company shall not be liable for indirect, incidental, or consequential damages
• The Company shall not be liable for financial or trading losses
• The Company shall not be liable for data inaccuracies or delays

Total liability is limited to the amount paid by the user in the last 12 months.

Nothing in these Terms excludes liability for intent or gross negligence, or for injury to life, body, or health.

14. Indemnification

You agree to indemnify and hold harmless the Company from claims arising from your use of the App, your violation of these Terms, or your content.

15. Data Protection

Personal data is processed in accordance with our Privacy Policy.

16. Changes to the Terms

We reserve the right to modify these Terms at any time. Users will be informed of material changes.

17. Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of the Federal Republic of Germany and the applicable law of the European Union, to the exclusion of any conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the country in which the user has their habitual residence remain unaffected.

The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is the registered office of the Company in Germany, provided that the user is a merchant, a legal entity under public law, or a special fund under public law, or has no general place of jurisdiction in Germany or the European Union.

18. Severability

If any provision is invalid, the remaining provisions remain in effect.
